🔗 Min Hee-jin Cleared of ‘Occupational Breach of Trust’ Charges..HYBE: “Filing Objection” [Official]

This is an announcement from HYBE.

Regarding the decision not to refer the occupational breach of trust case that HYBE filed last year against former CEO Min Hee-jin and others to prosecutors, our company plans to immediately file an objection with the prosecution today.

New circumstances have emerged since the police investigation, including the NewJeans members’ declaration to terminate their contracts. A significant amount of new evidence has also been submitted in related court proceedings, and based on this, the court has judged former CEO Min’s actions very seriously. Given that the appellate court (Seoul High Court) in the injunction appeal proceedings determined that former CEO Min “is in a position of intentionally destroying the integrated structure that was the premise of the exclusive contracts,” we intend to contest the decision not to refer the case through the objection process.

Additionally, the investigative authorities have issued a decision not to refer to prosecutors, on the grounds of “no charges found,” the case in which former CEO Min Hee-jin and others filed criminal complaints last July against five HYBE executives for obstruction of business and defamation under the Act on Promotion of Information and Communications Network Utilization and Information Protection (defamation). The investigative authorities determined that HYBE’s claims were “difficult to regard as false information,” that “as the matter concerns the public interest, intent to defame is not recognized,” and that “the KakaoTalk conversations are recognized as having been obtained through legitimate authority during the audit process.”

Furthermore, we would like to inform you that decisions not to refer to prosecutors have also been issued for all cases in which former CEO Min’s side indiscriminately filed criminal complaints against HYBE and its affiliates’ executives and employees: ▲The case in which former CEO Min Hee-jin filed criminal complaints against BELIFT LAB executives and creative directors for defamation and false accusation; ▲The case in which Team Bunnies filed criminal complaints against BELIFT LAB executives and others for defamation under the Act on Promotion of Information and Communications Network Utilization and Information Protection; ▲The case in which Shin Woo-seok, CEO of Dolphiners Films, filed criminal complaints against ADOR’s current management for defamation under the Act on Promotion of Information and Communications Network Utilization and Information Protection—all have either been cleared with “no charges found” and not referred to prosecutors, or have been rejected.
